What is the role of law in this process? △Tha fastest growth rate of student enrolment is in law schools. △Institutions are law? ．Some scholars, such as Douglass North consider that institutions are made up of formal rules(statutory laws) and informal rules(social norms, common law). If so, institutional change is nothing more than rewriting laws, as social norms are rather slow to change anyway. △Good for institutional analysis? ．Formal game-theory: von Neumann, Morgenstern, Nash ．Intuitive analogy of the society with the game: Adam Smith, von Hayek ．Synthesis with cognitive sciences? Douglass North(Understanding the process of economic change, 2005) △Different concepts of institutions ．Formal and informal rules of the game. ．Shared beliefs about how the game is being played. △（圖表，略） △Is law an institution? ．Common law or nomes/lawyers' law(Hayek) =equilibrium =institutions ．Thesis/legislators' law(Hayek) =creates certain expectations and incentives among the players and thus a certain configuration of strategic behaviors, which may or may not be consistent with legislator's intention. ．Law cannot be enforced if it dose not fit existing institutions and/or if there is no accumulation of ... △Law in the transition ．There is an increasing rate of law suits in contractual disputes in China. ．It is said that in Japan there were fewer law suits because of Japanese disliking of open quarrel[Is that so? If so, why?(Ramseyer)]. However, there have recently risen important cases of corporate disputes brought to the formal legal process(UFJ Banks, Nippon Boardcasting Co.). ．In the transition, there is a high degree of uncertainty.
