You will be subject to H1B cap if you transfer from a non-cap institution
(such as non-profit) to a regular private company.
All employment-based visa status is tied to the specific employer that
sponsor you. Your employer (old or new) would have to sponsor you and
pay for the associated fees (legal and government).
