Law and order in Taiwan The law system in Taiwan is quite different from one in the UK. We don’t have a jury in court whereas all sentences are given by judges and based on written laws. The personality of judge is very important and it is true that judes play vital roles in court so that some judges could be bribed on the past and the judgements were seen unfair at all. The most famous case in the history of Taiwanese Law system could be a murder happened decade ago. The host and hostess were killed cruelly with hundreds of wounds and the whole process were witnessed by their little boy aged about 12 at the moment. The crime was really a stunning news in Taiwanese society and loads of police officers joined the investigation and the suspects were found just a few days later. It seemed that everything was totally under control by the police. However, it was just the controversy it was. The reason why it become controversial is that even though the police did investigate the crime and collect the evidence, some procedures of the investigation were not legal so that the evidence became unsustainable. What’s worse, the rest of three suspects were charged with oral statement by the main suspect who was executed immediately. The three suspects also argued that they were questioned with torture in court. Some parts of the investigation were found illegal and then all the procedures became useless in court. So, it had finally become impossible for the judge to make a proper decision. Even though the judge finally gave a sentence of execution, no minister of justice have dared to permitted it since that time because it was too debatable a case and those three people were put in jail till few years ago. But One of them had become mentally abnormal, unfortunately. The case really shows the difference between the law system in Taiwan and in the UK.Sometimes it is easy for us to judge a suspect if he or she is guilty and innocent according to those written words while sometimes it turns out to be bizarre because once you follow the stiff laws and inflexible regulations, your sentences become ridiculous and unbelievable for the victims or the public. On the other hand, due to the jury in the law system in the UK, we can at least be sure that the sentence made by the jury who represent the public will be not so far-fetched for the public. -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 118.165.220.121
